Purpose and scope of the GTC

The Service Provider has issued this GTC in order to regulate in detail the ordering and participation rules for the announced programs, the cancellation conditions, the rights of interested people and participants and other relevant circumstances.

In the case of matters, not regulated by the GTC, the Hungarian laws and regulations are in force at any given time, as well as the provisions of the Civil Code, shall be governed by and without any special provisions.

The GTC is published on the www.kristiankielmayer.com website and continuously available there.

The Service Provider is entitled to unilaterally modify the GTC and the amendment will be publish on the website. The amendment of the GTC shall enter into force at the earliest on the 15th day after the publication of the amendment. The amendment may not make the application and participation conditions more burdensome for participants, who have already announced programs.

 

Scope of the GTC

The personal scope of the present GTC covers the Service Provider, the people applying for and participating on the programs (hereinafter: Customers), the visitors and the users of the website.

The scope of the present GTC covers the programs sold by the Service Provider.

 

Order:

Prices are not listed on this website, as they are all subject to individual agreements.

Unless otherwise specified, the price includes all taxes and other costs incurred. When using the program or service, the items will be listed that are included and not included in the price. The following information shall be provided by the Customer:

 

  • the exact name
  • the ordered service
  • the date / time of the service
  • the electronic mail address

The use of the program or the service is personal, and the Customer may not act on behalf of a third party.

All services are subject to availability. Service Provider reserves the right to change the program.

Minor changes to the advertised program (e.g.: possible change of location, detour, re-routing, forced change of program) do not justify the Customer reclaiming the paid price of the service.

 

Payment deadline:

Failure to meet the payment deadline constitutes a serious breach of contract by the Customer with regard to this, the Service Provider is entitled to cancel the order, and the Customer is obliged to reimburse the Service Provider for the expenses incurred.

 

Obligation to cooperate:

The Customer and the Service Provider shall act in good faith and mutually co-operate with each other in the execution of the order and service. Within this framework, they shall notify each other promptly of any changes in their availability and circumstances relevant to the order. The consequences of failure to comply with the obligation to cooperate shall be borne by the defaulting party.

 

Modification Terms:

The Service Provider and the Customer may modify the order only by mutual agreement in writing.

 

Cancellation policy:

If the Customer cancels the ordered program at least 14 days before the date of service, the Service Provider will charge 20% of the order amount as a cost.

If the Customer cancels the ordered program 6-13 days before the date of service, the Service Provider will charge 50% of the order amount.

If the Customer cancels the ordered program 5 days before the date of service or does not show up at the agreed time or location, the total amount will be charged, 100% of the amount will be withheld.

If the ordered program is cancelled by the Service Provider, the full paid amount will be refunded to the Customer. In addition, the Customer may not claim any additional costs or other claims against the Service Provider.

Special circumstances (e.g.: bad weather) may be the subject of an individual agreement.

 

Responsibility:

The Service Provider shall not be liable for any accident, personal injury, theft or damage of the Customer during the program.

 

Assorted and final provisions:

Customer may report any problems with the sales of programs and services to the Service Provider in writing by sending a letter to the address of the Service Provider or electronically at kristian@www.kristiankielmayer.com.

The Service Provider informs the Customer that in case of rejection of the complaint submitted by him/her, he/she is entitled to appeal to the capital office or the county government office acting in the field of consumer protection. The Government Office of the place of residence of the Customer or the seat of the Service Provider shall be competent to decide the case. The application may be submitted to any competent government department.

The Service Provider informs the Customer that the conciliation body shall have jurisdiction over out-of-court disputes (consumer disputes) between the Customer and the Service Provider regarding the quality, safety, application of product liability rules, quality of service and the conclusion and performance of the contract between the parties.

To this end, the conciliation body shall attempt to reach a settlement between the parties and, if it fails, shall decide on the matter in order to ensure the simple, expeditious, effective and cost-effective enforcement of consumer rights. At the request of the Customer or the Service Provider, the conciliation body shall advise on the rights and obligations of the Customer. The conciliation body is an independent body operating alongside the county (capital) chambers of commerce and industry.

The Service Provider shall try to settle any disputes arising in connection with the interpretation and fulfilment of these GTC primarily by way of settlement with the Customer.

Should any provision of the GTC be invalid or void for any reason, it shall not result in the invalidity or nullity of the other provisions of the GTC. In such a case, the Service Provider shall amend the GTC in order to eliminate the cause of nullity or invalidity.
